MARKAI ADVERTISING POLICY

INTRODUCTION

This Advertising Policy sets out the types of content that may and may not be advertised on the MarkAI Platform. All advertisers must ensure that their creative content (images, videos, text, animations) complies with this policy before submission. Failure to comply may result in: • Rejection of your ad • Removal of your campaign • Suspension or termination of your account • Forfeiture of payment • Reporting to authorities

2. PROHIBITED CONTENT CATEGORIES

2.1. Illegal Products and Services

You may NOT advertise:

2.1.a. Products or services prohibited under Indian law

  • Narcotic drugs and psychotropic substances
  • Counterfeit or forged goods
  • Weapons, explosives, or dangerous items
  • Stolen property
  • Services related to prostitution or human trafficking

2.1.b. Services that facilitate illegal activity

  • Money laundering or financial fraud
  • Unlicensed financial services
  • Pyramid schemes or multi-level marketing (MLM) without proper registration
  • Unregistered insurance or investment schemes

2.1.c. Products banned by regulatory authorities

  • Banned tobacco products or unregistered alternatives
  • Non-approved pharmaceuticals or medical devices
  • Hazardous chemicals restricted by law

2.2. Health, Medical, and Pharmaceutical Content

You may NOT advertise:

  • Prescription medications without proper regulatory approval from Ministry of Health and Family Welfare, India and Central Drugs Standard Control Organization (CDSCO)
  • Medical devices or treatments: Unproven or scientifically unsupported medical claims, 'Miracle cures' or miraculous health benefits, Alternative medicines that contradict scientific evidence
  • Health services: Unregistered medical practitioners or unauthorized clinics, Reproductive/abortion services (unless legally permitted and properly licensed)
  • Health supplements and nutraceuticals: Making unauthorized disease claims, Claiming to replace medical treatment

2.3. Alcohol, Tobacco, and Intoxicants

You may NOT advertise:

2.3.a. Alcohol

  • Except for registered spirits companies with proper ABMRN
  • Ads must include statutory warnings
  • Cannot target minors
  • Cannot be displayed near schools or hospitals

2.3.b. Tobacco and tobacco products

  • Cigarettes, bidi, chewing tobacco (unless legally permitted)
  • Includes 'smoke-free' or e-cigarette alternatives marketed as tobacco substitutes
  • Advertising is restricted by law; we do not permit tobacco ads

2.3.c. Intoxicants and stimulants

  • Pan masala, gutkha, mawa (unless specifically licensed)
  • Refer to ASCI Code and Indian law

2.4. Financial, Investment, and Forex Products

You may NOT advertise without proper regulatory approval from: SEBI, RBI, IRDA. Specifically prohibited:

  • Unregistered investment schemes or Ponzi schemes
  • Forex trading products to retail investors (restricted by RBI)
  • Unlicensed cryptocurrency or non-sovereign digital asset trading
  • Unsecured lending or 'instant loan' apps with exorbitant interest rates
  • Stock tips or guaranteed returns on investment (unless from registered brokers with disclaimers)
  • Must include: Regulatory disclaimers, Clear disclosure of risk, Company registration details

2.5. Educational Content

You may NOT advertise:

  • Unaccredited or fraudulent educational institutions
  • Degrees or certifications that are not recognized by Indian regulatory bodies (UGC, AICTE, NCTE)
  • Fake certifications marketed as equivalent to formal education
  • Any educational service without proper registration or legal status

2.6. Real Estate

You may NOT advertise:

  • Properties without proper legal ownership documentation
  • Unapproved or illegal housing projects
  • Projects violating building regulations or environmental laws
  • Misleading geographical descriptions or false claims about property location

3. OBJECTIONABLE AND HARMFUL CONTENT

3.1. Defamatory and Harassing Content

You may NOT advertise content that:

  • Defames, libels, or makes false allegations about individuals or companies
  • Harasses, bullies, or intimidates any person or group
  • Incites violence, hatred, or discrimination against: Any individual or group, Religious or ethnic communities, Gender or sexual orientation-based groups, People with disabilities
  • Makes disparaging claims about competitors without factual basis

3.2. Sexually Explicit and Inappropriate Content

You may NOT advertise:

  • Sexually explicit images, videos, or descriptions
  • Adult content or services (unless legally permitted and age-gated)
  • Escorts, dating services with sexual undertones
  • Products designed primarily for sexual purposes
  • Content that objectifies or demeans people based on gender

3.3. Violence and Dangerous Content

You may NOT advertise:

  • Violence or graphic depictions of harm
  • Self-harm, suicide, or content encouraging these
  • Dangerous activities that could cause injury
  • Weapons, explosives, or products designed to harm
  • Instructions or tutorials for illegal or dangerous activities

3.4. Hateful Content

You may NOT advertise content promoting discrimination based on: Race, ethnicity, or caste; Religion or beliefs; Gender or gender identity; Sexual orientation; Disability or medical condition; National origin or citizenship. This includes conspiracy theories or misinformation about protected groups and symbols or rhetoric associated with hate movements.

3.5. Misinformation and Fake News

You may NOT advertise:

  • Knowingly false or misleading claims
  • Election misinformation or propaganda
  • False health information (e.g., vaccines cause autism)
  • Conspiracy theories presented as fact
  • Manipulated images or deepfakes presented as real

3.6. Child Safety

You may NOT advertise:

  • Content exploiting, sexualizing, or endangering children
  • Products sold specifically to minors that are harmful (e.g., weapons, adult content)
  • Content that could endanger minors' physical or emotional well-being
  • Child abuse material (NCMEC violations)

4. DECEPTIVE PRACTICES

You may NOT:

  • Make false or misleading claims about: Product benefits or features, Price or value, Availability or scarcity (fake urgency), Origin or authenticity, Endorsements or awards
  • Use misleading testimonials or fake reviews
  • Bait-and-switch tactics (advertise one product, deliver another)
  • Hide material terms or conditions in fine print
  • Misrepresent legal status or approval (e.g., 'FDA approved' when it's not)
  • Use non-transparent referral or pyramid scheme marketing

5. INTELLECTUAL PROPERTY VIOLATIONS

You may NOT advertise:

  • Content using: Copyrighted material without permission, Trademarked logos or brands without authorization, Patented designs or technologies you don't own
  • Counterfeit goods
  • Content infringing celebrity or influencer rights without permission

8. CONTENT STANDARDS AND GUIDELINES

8.1. Technical Requirements

All creative must be:

  • High quality and non-pixelated
  • Properly formatted for the display medium
  • Free of technical errors or distortions
  • In compliance with file size and format requirements
  • Video content must: Have clear audio (properly mixed), Have legible text and proper color contrast, Load without errors

8.2. Language and Messaging

8.2.a. Avoid

  • Excessive use of symbols or emojis that obscure meaning
  • All-caps text (considered 'shouting')
  • Gratuitous use of profanity or slurs

8.2.b. Messaging must

  • Be clear and honest
  • Not use manipulative or coercive language
  • Respect consumer autonomy

10. ASCI CODE COMPLIANCE

All advertising must comply with the Advertising Standards Council of India (ASCI) Code for Self-Regulation in Advertising, including:

10.a. Decency

  • No obscene or objectionable content
  • No content that could offend public decency

10.b. Honesty

  • Truthful and honest representation
  • No misleading claims or exaggerations

10.c. Responsibility

  • Social responsibility in advertising
  • Particular care for vulnerable groups (children, elderly)

10.d. Fair Competition

  • No unfair disparagement of competitors
  • No passing off as competitor's product

11. CONTENT REVIEW PROCESS

11.1. Pre-Approval Review

  • All submitted creative content undergoes review before approval
  • Our team checks compliance with this policy, Indian law, and ASCI guidelines
  • Review time: 1-3 business days (expedited review available for premium clients)

11.2. Rejection

If content is rejected: We provide reason for rejection, You may resubmit revised content, Rejection does not entitle you to refund

11.3. Removal After Approval

Even if content is initially approved, we may: Remove it if new information reveals policy violation, Remove it if there is a complaint from viewers or authorities, Remove it in response to legal or regulatory action

13. COMPLIANCE WITH INDIAN LAW

All advertising must comply with: Indian Penal Code (defamation, obscenity, hate speech), Consumer Protection Act, 2019 (false claims, unfair practices), Information Technology Act, 2000 (cyber offenses), ASCI Code for Self-Regulation in Advertising
